Once again, I was thwarted by my counsel from disputing the two Oxnard police officer's account of what transpired that night. By public defender Dino Inumerable's flat refusal to let me give my testimony under oath.
It was this incident, added to eight months of refusing to inteview my witnesses, secure the police radio traffic logs, (that would show that instead of my arrest being the result of a "random, routine, probable cause induced; Stop, search, and arrest, as these two officers portrayed it as being, my arrest was the culmination of a three weeks, several times a day, and night onslaught of; Stops, threats, etc., that finally built up to my being falsley arrested, by police officers that planted drugs on me.
If my public defender would have secured these police call logs, they would have shown that neither Oxnard P.D., Ventura County Sheriffs Dept., nor any law enforcement agency in the nation had ANY INTEREST AT ALL in my person for over a decade, or more before the three weeks, night and day stops, checks, and harrassments that I underwent before my arrest on 12-27-2001.
After the hearing, I told public defender Dino Inumerable that I wanted to exchange him for; "adequate counsel" In Calif. Superior Court this is called a; "Marsden Hearing." This hearing was set for eight days later on 11-22-2002.
I knew that I was in desperate need of effective counsel, and that public defender Inumerable was at my side in defense of someone 's interests other than mine.
By requesting a Marsden hearing, I am "telling the court" that I DON'T want to be my own legal represenitive. I am making the statement that I want "effective counsel" and that I am not getting "effective counsel" from the public defender that I have been assigned.
